The firm has recently undertaken the following assignments:
Acted
as legal counsel on the re-organization and administration
of the Greek Energy Regulator (RAE) and drafted the Presidential
Decree which will replace Presidential Decree 139/2001.
The new decree deals de novo with RAE’s rules on organisational
processes, decision-making, structures and account management,
on public procurement procedures, and on dispute resolution
mechanisms.
Advised
the governments of FYR Macedonia and of Moldova on legal
approximation with article 86 (2) of the EC Treaty and with
the Financial Transparency Directive. Work involved the
redrafting of both primary and secondary legislation for
the provision of so-called activities of general economic
interest, public service and public service obligations
to ensure compliance with the EU acquis communautraire on
competition (particularly article 86 (2) of the EC Treaty)
and with the so-called Financial Transparency Directive
that aims to ensure the equal treatment of public and private
undertakings.
Selected
to act as the legal counsel on a technical assistance project
in Moldova funded by the European Commission. The project
focused on electricity network interconnection and aimed
to support Moldova’s progressive integration into
the regional and eventually the EU energy markets. The firm
indicated the initiatives that the EU needed to take in
the short term to deal with Moldova’s growing energy
inadequacies, with its approximation with the EU acquis
and its accession to the Energy Community and the Energy
Treaty.
Advised
the government of FYR Macedonia on the approximation of
the country’s legislation on PPP and PFI with the
EU acquis communautaire and international best practice.
The firm has particularly advised on the tendering process
to be adopted so as to encompass PPP and PFI schemes as
well as contractual schemes with private operators (mainly
BOT contracts and their variants such as BO, BOOT or DBFO).
Reviewed
Moldova’s National Energy Strategy and prepared an
action plan for the country’s accession to the Energy
Community Treaty to which Moldova has made an application
to become a full member. It also prepared new draft primary
laws to replace the electricity and natural gas laws.
Has
been retained by a Greek renewable energy company to negotiate
and draft a multi-million venture capital agreement with
a mutual fund and a listed telecom company.
Has
been retained as the legal advisor of the Greek subsidiary
of an American energy undertaking for a multi-million private
placement.
Advises
a Japanese energy undertaking on its investments in the
Greek rernewable energy sector.
Acted
for buyer on the acquisition of a major mine in the island
of Rhodes.
Carried
out a legal approximation exercise in the energy sector
of FYR Macedonia by drafting secondary legislation for all
energy sub-sectors for the Energy Regulatory Commission
(ERC) of FYR Macedonia; recommending amendments to primary
legislation, particularly the national Energy Law and the
Law on Concessions; drafting model licences and authorizations
for all energy functions and activities; and ensuring full
compliance with the acquis communautaire and the Athens
Memorandum.
Drafted
end-user agreements with privatized district heating providers
to enhance energy efficiency in Romania.
Authored
the Greece chapter for Sweet & Maxwell's loose-leaf
leading publication "Energy Law & Regulation in
the European Union" as well as the chapters on Oil
and Electricity Regulation in the “Getting the Deal
Through” series published by the International Bar
Association and the Global Competition Review.
Advised
an international consortium of IPPs, the MacHydro Project
AD, on their investment and rehabilitation of a 210 MW hydro
power station in FYR Macedonia on the basis of a R.O.T (Rehabilitate,
Own and Transfer) concession agreement.
